TG RERA Invokes Section 8 of the RERA Act: Project Handed Over to Homebuyers

In a significant move that strengthens regulatory enforcement and boosts homebuyer confidence, the Telangana Real Estate Regulatory Authority (TG RERA) has taken over an undelivered residential project in Bowrampet and transferred its completion to the association of allottees. The project, Jaya Platinum—developed by Jayathri Infrastructures—had remained stalled for nearly two years beyond its promised completion date.

Project Delay and Buyer Distress

Jaya Platinum, located in Dundigal Municipality of Medchal-Malkajgiri district, attracted around 60 homebuyers with commitments of delivery by December 2022. Despite collecting substantial funds, the developer failed to progress construction meaningfully. Buyers were left managing dual financial pressures—monthly EMIs on home loans and rent for temporary housing—along with emotional strain over their uncertain investment.

Realising the prolonged inaction, the allottees approached TG RERA for redress. After examining the matter, RERA issued interim directions in April 2025, culminating in a landmark final order that authorised the association of homebuyers to assume control of the project’s completion.

Legal Action Under Section 8 of the RERA Act

Section 8 of the Real Estate (Regulation and Development) Act empowers RERA authorities to transfer the responsibility of an incomplete project to the allottees’ association when the promoter defaults on obligations. This provision is rarely invoked, as regulators typically prefer penalties, compliance orders, and timelines for rectification.

By invoking Section 8, TG RERA has taken one of its strongest actions yet—demonstrating the authority’s commitment to prioritising consumer interests and enforcing accountability in the real estate sector.

Formation of a Monitoring Committee

To ensure smooth execution and maintain project quality, TG RERA has formed a monitoring committee that includes representatives from Naredco (National Real Estate Development Council) and Credai (Confederation of Real Estate Developers’ Associations of India). This high-level panel is expected to guide the completion process, maintain transparency, and safeguard financial utilisation.

Industry Reactions and Impact on Buyer Confidence

The decision has been widely welcomed. Software professional and real estate analyst J. Ratnakar Yadav described the ruling as one of TG RERA’s finest interventions to protect genuine buyers. He emphasised that RERA’s proactive stance is compelling many builders to fulfil promises stated in brochures and agreements.

Similarly, Sai Hundekari, secretary of the residential welfare association at JD Lahari Homes, said the Bowrampet case proves that RERA will not allow cheating by errant developers. With such decisive actions, homebuyers feel safer despite occasional industry lapses.

Growing Complaints Highlight Market Challenges

The Hyderabad Metropolitan Region has recently witnessed rising consumer complaints, particularly involving pre-launch collections and non-delivery. TG RERA currently has 2,340 pending cases, with 493 specifically related to construction delays. This reflects the need for continued vigilance and regulatory strengthening.

For the allottees of Jaya Platinum, TG RERA’s decision offers long-awaited relief and renewed hope. It also sends a strong deterrent message to developers across Telangana: failure to honour commitments will result in firm regulatory intervention.
