TG-RERA Issues Notices to Developers Over RERA Violations

The Telangana Real Estate Regulatory Authority (TG-RERA) has issued show cause notices to Hastina Realty Private Limited and Sonesta Infra, Gachibowli, for violations of the Real Estate (Regulation and Development) Act, 2016. These notices are a result of the developers selling plots and advertising units without registering the projects with the regulatory authority, which is mandatory under Sections 3(1) and 4(1) of the RERA Act, 2016, and Rule 1(2) of Telangana Real Estate (Regulation and Development) Rules, 2017.

Violations by Hastina Realty Private Limited

Hastina Realty Private Limited has come under scrutiny for their project named “Brissa,” located along Srisailam Highway in Kadthal Town, near Pharma City. The company was found to be offering plots for sale without registering the project with TG-RERA, a clear violation of the RERA guidelines. The authority has directed the promoter to provide an explanation within one week from the receipt of the notice, failing which strict action will be taken as per the rules in force.

Infractions by Sonesta Infra

Similarly, Sonesta Infra, based in Gachibowli, has been caught selling plots in Jayabheri Pine Valley Colony, Gachibowli, specifically in Flat No. 201, Plot No. 13, without the necessary registration. This contravention of Section 3(1) of the RERA Act, 2016, has prompted TG-RERA to demand an explanation from the developer within a week. Non-compliance will result in appropriate actions as per the regulations.

Legal Framework and Compliance

According to Section 4(1) of the RERA Act, 2016, every promoter is required to make an application to the regulatory authority for the registration of the real estate project. This application must be in the prescribed form, manner, and time, and accompanied by the specified fee. Additionally, Rule 1(2) of the Telangana Real Estate (Regulation and Development) Rules, 2017, mandates that all real estate projects approved on or after January 1, 2017, must be registered with TG-RERA.

Section 3(1) of the RERA Act, 2016, explicitly prohibits promoters from advertising, marketing, booking, selling, or offering for sale any plot, apartment, or building without registering the project with the Real Estate Regulatory Authority. This measure ensures transparency and protects the interests of homebuyers.
