UP RERA Cracks Down on Promoters for Misrepresentation and Violations

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has intensified its actions against promoters and developers found violating the Real Estate (Regulation and Development) Act, 2016 (RERA). The authority has taken strict measures against several prominent real estate groups for misrepresenting facts, submitting fake documents, and failing to comply with mandatory norms.

According to officials, these actions mark a renewed push by UP RERA to ensure transparency, accountability, and protection for homebuyers in the state’s real estate sector.

FIR Lodged for Submitting Fake RERA Orders

In a major move, UP RERA lodged an FIR at the Greater Noida Police Commissionerate, Gautam Buddh Nagar, against a promoter accused of submitting fake RERA orders to a bank to obtain a loan. The incident was described as a serious act of forgery and misrepresentation, aimed at misleading financial institutions.

A UP RERA spokesperson confirmed that the regulatory authority acted swiftly, initiating legal proceedings against the promoter to prevent misuse of official documents and safeguard the credibility of the RERA framework.

Action Against Promoters for Misrepresentation

In another case, UP RERA took action against a prominent group facing 16 complaints for uploading misleading documents on the authority’s portal. Investigations revealed that the promoter uploaded a drawing of electrical installations and falsely labeled it as an electrical NOC to gain undue advantage during project registration.

Terming this a serious violation, UP RERA referred the case for punitive action under relevant sections of the Act, warning that such attempts to manipulate data will attract strict penalties.

Failure to Issue Allotment Letters in Prescribed Format

UP RERA also investigated nine complaints against another real estate group that failed to issue allotment letters to buyers in the prescribed format, as required under Section 13 of the RERA Act.

“This is a direct violation of Section 13 of the RERA Act. The Authority has taken it seriously and recommended penalties under Section 61,” said a UP RERA spokesperson.

The authority noted that such lapses compromise the legal protection of homebuyers and will not be tolerated under any circumstances.

Violations of RERA Orders and Status Quo Directions

In another complaint, UP RERA found that a developer violated a status quo order issued by the RERA bench. The violation led to proceedings being initiated under multiple sections of the Act, including Sections 13, 61, and 63, which allow for penalties and punitive action against repeated offenders.

The authority emphasized that all developers must respect judicial orders and comply with regulatory directions in letter and spirit.

Commenting on the recent actions, UP RERA Chairman Sanjay Bhoosreddy said,
“Action against promoters has sent a clear message that homebuyers will no longer be cheated. For years, people have suffered due to the arbitrariness and breach of promises by builders. Many did not get timely possession, essential documents were withheld, and false information was shared. This RERA action will strengthen the confidence of homebuyers and put pressure on builders to comply with the law.”

His statement highlights UP RERA’s determination to restore trust in the real estate sector and ensure fair treatment of buyers.

The manual provides a step-by-step guide for promoters, real estate consultants, and technical teams to file project registration applications efficiently. It is designed to make the registration process transparent and user-friendly, reducing the scope for errors and delays.

UP RERA’s recent crackdown sends a strong message to all stakeholders in Uttar Pradesh’s real estate market. Developers who attempt to evade compliance or mislead buyers will face strict legal and financial consequences.
