Society’s failure to fix leakage, fined Rs 60,000 payout

After the complaint filed before the additional Mumbai Suburban District Members Consumer Disputes Redressal Forum, it directed Mohatta Nagar cooperative housing society’s secretary to complete the repair work of buildings and flats in 3 months.

The two complainant’s had filed the separate complaint about failing to fix the leakage issue against the secretary of Mohatta Nagar Cooperative Housing Society on July 2015.

Now they have been awarded Rs 30,000 of compensation each for the mental agony meet.

The main reason behind the complaints was that the society did not keep the building in good condition it had even collected money from the members for the same. They alleged that their flats had become uninhabitable and it was required to do plastering work to make it inhabitable.

They further alleged that the building is in a poor condition and in critical need of repair.

They submitted that its society’s responsibility to keep building roof leakage free and out walls of the building. However, they submitted that letters were sent in 2014, to do concrete work of the pillars to make them stronger but it failed to work accordingly demands made in the letter.

The forum said the society is under obligation to undertake repair work of the society as per bye-laws so that the complainants and other members shall stay without any safety issues.

The Brihanmumbai Municipal Corporation (BMC) issued a notice in 2011 to the society saying that the old building on the site was unsafe, forum pointed out.

The forum said the society is authorised to collect an extra sum from members of society, and even from the complainants for major repair work.
