UP-Rera Guidelines for Builder-Buyer Settlements: Ensuring Transparency and Compliance

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has issued a public notice in newspapers, calling upon the parties to appear for an online hearing of 32 pending complaints. The regulatory body has warned of a “unilateral decision” if the parties fail to appear for the hearing.

Public Notice for Online Hearing:

UP RERA has scheduled 19 hearings at its Head Office bench in Lucknow and 13 at the regional office bench in Gautam Buddh Nagar. The regulatory body has stated that the parties have skipped “several dates” in the past, which is against the objectives of the RERA Act and the interests of the allottees or other stakeholders.

Last Chance for Parties to Appear:

The regulatory body has given a last chance to the parties to appear for the online hearing. The parties who do not appear for the hearing have caused delays in resolving the grievances of the complainants, resulting in the rescheduling of the hearing for a later date.

UP RERA has adopted the e-court model for hearing the complaints of home buyers online. The parties will be sent a link on their registered mobile number and email ID two days before the scheduled hearing date. By clicking on this link, the parties can join the hearing from any place.

Warning for Promoters:

UP RERA has warned the promoters that if they do not appear for the hearing even after this public notice, the benches will give a unilateral decision in favor of the complainants/allottees. The promoters/parties themselves will be responsible for any such decision.
