In a landmark move aimed at protecting home buyers, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has announced new regulations that hold developers accountable for the quality of construction. Effective immediately, developers are required to submit an annual quality assurance certificate to MahaRERA, ensuring that the construction standards of real estate projects meet the prescribed norms.

Builders’ Responsibility for Construction Quality

MahaRERA’s latest order, issued on August 20, 2024, makes it clear that builders can no longer evade responsibility for substandard construction. The regulatory body has emphasized that the quality of construction will be strictly monitored, and developers must provide an annual quality assurance certificate as proof of compliance. This certificate must also be made available on the developer’s website, ensuring transparency and allowing homebuyers to make informed decisions.

Key Aspects of the Quality Assurance Certificate

The quality assurance certificate will encompass several critical aspects of construction, including:

  • Structural Design: Verification of the structural integrity of the building.
  • Sustainability: Ensuring the building is constructed with sustainable practices.
  • Various Tests: Compliance with necessary tests for construction materials and processes.
  • Fire Safety: Adherence to fire safety standards.

MahaRERA has mandated that project engineers and supervisors present information related to these aspects. Before making the certificate public, developers are required to verify the details to ensure accuracy.

Developer Obligations and Homebuyer Rights

Under the new rules, developers are also obligated to rectify any construction deficiencies within five years from the date of possession. Additionally, MahaRERA has directed that any complaint raised by a homebuyer must be resolved within 30 days at no extra cost. This directive aims to enhance consumer protection and ensure that homebuyers receive quality homes.

The decision follows a consultation paper issued by MahaRERA in December 2023, with a draft proposal released in April 2024. After considering public suggestions until May, the regulatory body has now implemented these new rules with immediate effect.

MahaRERA has outlined a comprehensive framework for quality assurance in real estate projects. This includes:

  • Soil Investigation: Ensuring proper soil analysis before structure design.
  • Structural Engineer Appointment: Mandatory for every project.
  • Quality Control: Regular checks by site engineers.
  • Raw Material Testing: On-site facilities for testing materials like cement, steel, and concrete.
  • Safety Measures: Earthquake-resistant systems and flood prevention measures in place.

Developers must ensure that construction materials meet Bureau of Indian Standards (BIS) and maintain records of quality tests. If a third party conducts the quality testing, the developer must disclose the third party’s details in the certificate. The developer is also responsible for verifying and approving the quality of the construction.
