UP-Rera Guidelines for Builder-Buyer Settlements: Ensuring Transparency and Compliance

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has issued new guidelines to all industrial and housing development authorities to ensure accurate identification of project parts before issuing part-wise completion certificates (CC) or occupancy certificates (OC). This move aims to protect homebuyers’ interests and minimize litigation between stakeholders.

Mismatch in Project Details:

UP RERA has observed discrepancies between the names of completed towers, blocks, or units mentioned in part-CC or part-OC issued by planning authorities and the details provided by promoters at the time of project registration. This mismatch creates confusion for homebuyers regarding the completion status of their units or towers during the conveyance deed execution and possession handover.

New Guidelines for Planning Authorities:

To address this issue, UP RERA has instructed competent authorities to provide specific details about towers or blocks when issuing part-CC or part-OC. These details should match the names given at the time of registration with RERA or in the agreement for sale between the promoter and the homebuyer.

No Temporary CC or OC:

UP RERA has emphasized that issuing temporary CC or OC is not permissible under current laws and could adversely affect homebuyers. Temporary CC or OC can lead to complications for homebuyers who take possession based on such certificates, which may not be confirmed later by the concerned planning authority.

Obtaining Marketing Names of Projects:

To avoid mismatches between project names and their blocks or towers, UP RERA has advised planning authorities to obtain marketing names of projects, along with the number of units, from promoters during the application for map sanction. This measure will ensure clarity regarding the completion status of projects.

Standardization in the Sector:

UP RERA Chairman Sanjay Bhoosreddy stated that the regulatory body is continuously working to bring standardization in the sector to protect homebuyers’ interests and minimize litigation between different stakeholders.
