The Andhra Pradesh Real Estate Regulatory Authority (APRERA) has issued a strong public advisory cautioning homebuyers against investing in pre-launch offers or purchasing plots and flats in unregistered projects. The warning comes amid reports that some developers and real estate agents are collecting advance payments and marketing projects without obtaining mandatory RERA registration.

APRERA in-charge chairman and Municipal Administration Principal Secretary S Suresh Kumar emphasized that such activities violate the Real Estate (Regulation and Development) Act, 2016, and could result in legal consequences for both promoters and agents.

What the Law Says

Suresh Kumar stated:

  • Under Section 3 of the RERA Act, no promoter can advertise, market, book, sell, or offer any property without registering the project with APRERA.

  • As per Section 10, real estate agents cannot facilitate sales in unregistered projects.

“Promoters and agents must refrain from engaging in any financial transactions or promotional activities in the name of ‘pre-launch’ for unregistered real estate projects. Any violation will attract strict legal action under the provisions of the Act,” he said.

Public Advised to Verify Projects

Homebuyers have been urged to verify whether a project is registered with APRERA before committing any funds. Suresh Kumar stressed that buying into unregistered projects could lead to financial loss, delayed possession, or poor quality construction.

APRERA has also encouraged the public to use its official helpdesk to:

  • Confirm project registration status

  • Report violations

  • Seek redressal for grievances like construction delays, non-possession, or deviation from promised amenities

Message to Developers and Agents

All developers, promoters, and agents have been warned not to:

  • Conduct pre-launch activities

  • Collect advance payments from buyers

  • Market or promote non-registered projects

Those found violating these directives will face penalties and possible prosecution under the RERA Act.
