One of the main points addressed in the circular was the formula for calculating the occupancy price or possession amount of Gaothan plots for eligible project-affected persons (PAPs) under various Maharashtra Rehabilitation Acts (1976, 1986, and 1999). The following steps were outlined for calculating the occupancy price:
- For Land Acquired by the Government:
The occupancy price should be calculated by taking into account the amount spent on acquiring the land, plus additional expenses related to land improvement, demarcation, leveling, and boundary setting. However, if this calculation exceeds the earliest estimate for the same plot, the occupancy price will be adjusted according to the earliest computation. - For Government-Owned Land:
If the Gaothan plot is on land originally owned by the government, the occupancy price will be calculated based on the earliest recorded estimate of the plot’s value.
Allotment of Gaothan Plots to Extended Families of PAPs
A significant issue raised in the second GR involves the allocation of Gaothan plots to extended family members of project-affected persons. In many cases, villages displaced due to irrigation projects have been waiting for rehabilitation for over 20 years. During this period, the number of family members of eligible PAPs has increased, leading to a demand for more Gaothan plots.
The government has ruled that in villages where rehabilitation has been delayed since January 1, 2003, due to administrative reasons, additional Gaothan plots will be allocated to accommodate the growing number of family members. However, this benefit will not be extended to PAPs who have previously declined the allocation of Gaothan plots.
