Karnataka RERA issue SOP for modified plans


Karnataka RERA have issued a circular K-RERA/EnggSec/Modified Plans/2019 dated 24th June 2020 for procedure to be adopted for processing and incorporating the Modified Plans sanctions and lay outs  Plans in the registered project under section 14 of the Real Estate (Regulation and Development) Act 2016.

A consent of Land owner , 2/3rd Allotees, which ever case may be is required before submitting the modified plans.

Gujarat RERA extend deadline to submit QPR

Gujarat RERA in its Order : GujRERA/Order-32 dated 30/3/2020 have extended the date to submit quarterly reports on projects till 7th April and 7th May 2020. The Order said : In view of the government directions and lockdown situation, it has been decided to
extend the QPR-Quarterly Progress Report filling due date for GujaratRERA registered
real estate projects as follows
I. For Intermediate QPR submission due date is extended from 7th April 2020 to 7th
May 2020;
II. For submission of the project end compliance, all projects having project End date
due up to 7th May, 2020 will have to file their Project End QPR on or before 7th
May 2020.
Thereafter, the promoters would be required to file regular quarterly updates for
subsequent quarters in normal course on respective QPR submission due dates, in
compliance with section-11 of the Act.

RERA Order passed without Notice is recalled by Gujarat High Court

In the case of Narayan Realty, Gujarat High Court in the second appeal have recalled the order passed by the Gujarat RERA. The Second appeal had maintained that there was no notice given to Respondents while passing an Order dated 20.11.2019.

The Hon’ble Court had, in the second appeal, given natural justice pleaded by the Respondents who have pleaded a review of the Order dated 20.11.2019 passed by the Hon’ble Gujarat RERA Authority.

Registration detail Fonts must be equal to content font size: Gujarat RERA

Gujarat RERA in its circular Gujrera/circular/18/2020 dated 4th January 2020 have instructed Promoters to use readable fonts in their project advertisements and also mention the website address of the authority in proper readable font. I

Previously, in its circular 13, the authority had directed all concern to use the registration number and web address of the authority in all promotion materials. In the current circular no 18, the authority have directed all the promoters and agents to use font size equal to the content of the advertisement. The circular said “The Font size of RERA registration number and website address should be mandatorily equal to or larger than the contact details of the proposed project”.

The direction has warned  promoters/builders/developer/agents of strict action against them for non compliance of the direction.
