Recently the State Consumer Disputes Redressal Commission mentioned that stilt parking or open parking both of which are part of common facilities and builders have no rights to sell parking space.
According to the Commission only housing society’s general body having rights to allot the parking space to flat owners. The commission directed Vardhaman Homes to give an account of Rs 9,045 collected as maintenance and other expenses, and also pay Rs 5,000 as compensation to the complainant, Dilip Joshi, and his wife, Deepa.
The advocate and his wife has lodged the complaint against the Vardhaman Homes had sold parking spaces to some residents of their building in Thane (W). According to the Joshis meeting had called between flat purchasers and the builder, when the latter was told that such spaces could not be sold under the Maharashtra Ownership Flats Act. But the builder told the members that there would be no refund, and such rulings should be ignored as they keep changing everyday.
The commission has said that “the builders and developers can not sell parking space and also have no right to interfere in society’s concern, the society and general body are the supreme authorities to decide issues faced by complainants pertaining to open parking and stilt parking space.”

  1. it is unfortunate that some of the builders which you have given prestigious continue to do the same.
    They may have charged for parking for some way or the other
